Since the district court properly determined that

Garcia’s claim was properly exhausted and he

did not forfeit that claim by not re-arraigning a second time, we affirm the

district court’s denial of habeas relief. AFFIRMED.

I concur in the majority’s conclusions that Garcia is not entitled to

18

habeas relief because there was no “deadlock” and because the state

19

did not deny Garcia due process by failing to make a timely motion to

20

rearraign. See Garcia v. Schriro, 613 F. Supp. 2d 976 (D. Ariz.

21

2007). I also agree with the majority’s conclusion that the state courts

22

denied Garcia relief on the basis of an independent and adequate state

23

procedural rule. However, because I believe the state court also

24

misapplied the procedural rule, I would reverse the district court’s

25

judgment and remand for the district court to enter summary judgment

26

for Garcia.

Procedural Rule 32.2.

The majority assumes that when a guilty plea is subsequently

29

withdrawn,1 a second arraignment must be held to permit the state to

30

withdraw the plea. Garcia objected to that requirement in the

31

arraignment. The state then tried to correct any error by agreeing

32

with Garcia’s objection. However, the state’s “consent” to Garcia’s

33
